Personal data protection policy

1. Introduction

S.C. HART Human Resource Consulting SRL undertakes to protect the personal data provided by the persons with whom it collaborates.

In order to ensure that your personal data is safe, we regularly communicate the personal data protection policy and the work instructions regarding this aspect to all the clients of S.C. HART Human Resource Consulting SRL and we monitor the strict application of the measures for the protection of private life within the organization.

This personal data protection policy describes our practices regarding the collection, use and transfer of data communicated directly or indirectly to our organization, and the manner of using the personal data for providing services.

2. Collected personal information

S.C. HART Human Resource Consulting SRL. provides consultancy services focused on diagnosis and performance enhancement on individual and organizational level, and for this purpose it collects and processes personal data received either directly, from the data subject, or indirectly, from legal-entity clients, which, based on a commercial contract, request the services of S.C. HART Human Resource Consulting SRL. We would like to state that these legal-entity clients ensure an adequate level of personal data protection, confirmed by written agreements, concluded with our organization.

Personal data is collected/processed/stored in a controlled manner, by technical and organizational measures implemented by S.C. HART Human Resource Consulting SRL.

S.C. HART Human Resource Consulting SRL. treats personal data in a manner compatible with the requirements of Directive EU 95/46 and those of Regulation 679/2016.

S.C. HART Human Resource Consulting SRL. Collects / processes / stores only the data that is necessary and relevant for providing services, in virtue of the contract concluded with its natural-personal or legal-entity clients.

The data that is collected and processed by us include personal data such as: surname, first name, contact data, e-mail, telephone, age, position.

The legal grounds for processing the aforementioned data by S.C. HART Human Resource Consulting SRL. is, as the case may be, the compliance with contractual obligations, legitimate interest or consent.

In order to ensure the compliance with Regulation 679/2016 S.C. HART Human Resource Consulting SRL. revises the impact assessment periodically, at maximum intervals of 3 years.

3. Using and communicating personal information

S.C. HART Human Resource Consulting SRL., in order to provide services, may communicate your personal data to its partners, which ensure a level of personal data protection similar to the one presented in this Personal data protection policy, based on the agreements signed with them.

Ways in which we use and/or communicate your personal data:

S.C. HART Human Resource Consulting SRL. may use personal data collected for providing services (development centers, assessments, data updates, request replies, telephone contacts, commercial communications);

Personal data may also be used for proposals, presentations, surveys, service improvement, advertising, marketing and public relations;

The information received by S.C. HART Human Resource Consulting SRL. from our clients, including contact data, is collected, kept and used at the necessary protection level.

The personal information collected by S.C. HART Human Resource Consulting SRL. is used only for the presented purposes.

  • The right to oppose automatic processing, including profiling.

S.C. HART Human Resource Consulting SRL., upon your request, may confirm whether and what information it has about you and the manner in which it is processed.

If S.C. HART Human Resource Consulting SRL. refuses your request, for example, based on the right to access, we shall provide the explanation of this decision, which you may legally appeal.

S.C. HART Human Resource Consulting SRL. transfers your personal information to third parties, by complying with the written agreements concluded with them.

If at any time we decide to use personal data in a manner different from the one declared when it was collected, we shall make this aspect public, we shall notify you and we shall provide you the possibility to choose whether we may use your information in this different manner or not.

If S.C. HART Human Resource Consulting SRL. is obligated by a legal act (law, ordinance) or judgment, or by administrative acts issued by competent authorities (articles of association, regulations, resolutions) to communicate personal data, we shall comply without the notification or approval of the data subject.

4. Information security

In order to prevent unauthorized access, in order to maintain the accuracy of data and correctly use data, we implement reasonable and adequate physical security, IT and organizational measures in order to efficiently protect all the personal data we collect/store/process.

In order to prevent the measures presented in this Personal data protection policy, we shall make all efforts in order to ensure that the data is correct, complete, current and relevant for the intended use, and the modifications to be applied shall be described in the updated version.

S.C. HART Human Resource Consulting SRL. shall periodically test and revise the measures used for protecting data against risks of loss, incorrect use, unauthorized access, disclosure, modification or illegal deletion/destruction.

You may periodically consult this personal data protection policy in order to be informed about the most recent version of this document.

6. Storage/processing duration

The duration of storage/processing of personal data is equal to the contractual terms established with each beneficiary, but no more than 3 years from the date of contract termination.
